Marivue, Inc. (“Marivue,” “we,” “us,” or “our”) provides an intelligence platform for maritime port and terminal operations that integrates with a customer’s Terminal Operating System (“TOS”). We are committed to protecting the privacy of website visitors, prospective customers, and the people whose data we process on behalf of our customers.
1. Scope & our role
This policy applies to two distinct situations, in which our role differs:
- As a controller — for personal data we determine the purposes and means of processing, such as data about website visitors, marketing contacts, and the administrative users of our platform.
- As a processor — for the operational and any personal data contained within a customer’s environment that we process on their documented instructions to deliver the platform. That processing is governed by our customer agreement and Data Processing Addendum (DPA), and the customer is the controller.
2. Information we collect
Information you provide
- Contact & demo requests — name, work email, company, role, your TOS, and any message you submit through our forms.
- Account data — credentials and profile details for authorized platform users.
- Communications — records of your correspondence with us.
Information we collect automatically
- Usage & device data — IP address, browser and device type, pages viewed, and similar log information from our website and application.
- Cookies — see Cookies & analytics.
Operational data via your TOS
When delivering the platform, we process operational data from your TOS and related feeds (for example vessel, berth, yard, crane, and gate events). This is generally commercial and operational data rather than personal data; where it does include personal data, we process it as a processor — see Customer & operational data.
3. How we use information
- To provide, operate, secure, and improve our website and platform.
- To respond to demo requests, enquiries, and support tickets.
- To manage accounts, authentication, and access control.
- To send service and, where permitted, marketing communications.
- To monitor performance, detect abuse, and maintain security.
- To comply with legal obligations and enforce our agreements.
4. Legal bases (GDPR)
Where the EU/UK GDPR applies and we act as a controller, we rely on: performance of a contract (to provide services you request); legitimate interests (to operate, secure, and promote our business, balanced against your rights); consent (for certain cookies and marketing, which you may withdraw); and legal obligation (to meet our compliance duties).
5. Customer & operational data
For data within a customer’s environment, the customer is the controller and Marivue is the processor. We process such data only on the customer’s documented instructions, as set out in the customer agreement and DPA. Our integration is designed to be read-only and least-privilege; we do not write back to your system of record. If you are an individual whose data may be held by one of our customers, please direct privacy requests to that customer as the controller.
6. Sharing & subprocessors
We do not sell personal data. We share it only with:
- Subprocessors — vetted service providers (e.g. cloud hosting, infrastructure, analytics, and communications) acting on our behalf under contract. Our current subprocessors are listed in Annex III of the DPA.
- Professional advisers and authorities — where required by law, regulation, or legal process, or to protect rights and safety.
- Corporate transactions — in connection with a merger, acquisition, or asset sale, subject to this policy.
7. International transfers
We may process and store data in countries other than your own. Where we transfer personal data internationally, we use appropriate safeguards such as the European Commission’s Standard Contractual Clauses (and the UK Addendum/IDTA where applicable), together with supplementary measures as needed.
8. Data retention
We retain personal data only as long as necessary for the purposes described here, to comply with legal obligations, resolve disputes, and enforce our agreements. Customer and operational data are retained and deleted in accordance with the customer agreement and DPA.
9. Security
We maintain technical and organizational measures designed to protect personal data, including encryption in transit and at rest, least-privilege access controls, logging, and monitoring. Learn more on our Security page. No method of transmission or storage is completely secure, but we work continuously to protect your information.
10. Your rights
Depending on your location, you may have rights to access, correct, delete, port, restrict, or object to the processing of your personal data, and to withdraw consent. If you are in California, you may have rights to know, delete, correct, and opt out of “sharing”/“sale” (we do not sell personal data), without discrimination. To exercise any right, contact privacy@marivue.com. You may also lodge a complaint with your local supervisory authority.
11. Cookies & analytics
We use strictly necessary cookies to operate the website and, with your consent where required, analytics cookies to understand usage and improve our services. You can control cookies through your browser settings and, where offered, our cookie banner.
12. Children’s privacy
Marivue is a business-to-business service not directed to children, and we do not knowingly collect personal data from anyone under 16.
13. Changes to this policy
We may update this policy from time to time. Material changes will be indicated by updating the “Last updated” date above and, where appropriate, by additional notice.
